Terms of Service
Welcome to Criticscale. These Terms of Service ("Terms") govern your access to and use of the Criticscale mobile app, our website at criticscale.com, and any related services (together, the "Service"). By creating an account or otherwise using the Service, you agree to these Terms.
1. Eligibility
You must be at least 13 years old to use Criticscale. If you are under the age of majority where you live, you may use the Service only with the involvement of a parent or legal guardian who agrees to these Terms on your behalf.
2. Your Account
You are responsible for any activity that happens under your account. Keep your sign-in credentials secure, choose a username that does not impersonate or harass others, and notify us if you believe your account has been accessed without permission.
We may suspend or terminate accounts that violate these Terms, abuse the Service, or harm other users.
3. Using the Service
Criticscale gives you a daily set of music games, score and streak tracking, friend features, and head-to-head challenges. You may use the Service for personal, non-commercial enjoyment. You agree not to:
- Reverse-engineer, scrape, or attempt to access the Service in ways we haven't authorized.
- Interfere with the integrity of scoring, streaks, leaderboards, or daily content (including using bots or automated input).
- Upload usernames, display names, bios, or avatars that are abusive, hateful, sexually explicit, or that infringe someone else's rights.
- Harass, threaten, or repeatedly contact other users after being blocked.
- Use the Service to violate any law.
4. User Content
You retain ownership of the content you submit (usernames, bios, avatars, reports, messages). By submitting it, you grant Criticscale a worldwide, non-exclusive, royalty-free license to host, display, and operate that content for the purpose of running the Service. You can delete most user content at any time from within the app.
5. Music and Third-Party Content
Game rounds may reference song titles, artist names, album artwork, release years, and other music metadata. All trademarks, copyrights, and rights in third-party music content belong to their respective owners. Their inclusion in our games is for editorial and gameplay purposes and does not imply endorsement.
6. Subscriptions and Payments
Some features (such as Pro tier and access to past challenges) require a paid subscription. Subscriptions are billed through Apple's App Store or Google Play according to their terms, including auto-renewal. To cancel, manage your subscription in the platform's settings — uninstalling the app does not cancel a subscription.
Refund eligibility is governed by the platform you purchased through (Apple or Google). We don't process refunds directly.
7. Disclaimers
The Service is provided "as is" and "as available." We make no warranty that it will be uninterrupted, error-free, or free of harmful components. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
8. Limitation of Liability
To the fullest extent permitted by law, Criticscale and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising out of or relating to your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us in the twelve months preceding the claim, or US $50 if you paid us nothing.
9. Termination
You can stop using the Service at any time and delete your account from Profile → Settings → Delete Account. We may suspend or terminate your access if you breach these Terms or if we discontinue the Service. Sections that by their nature should survive termination will survive (including disclaimers, limitation of liability, and dispute resolution).
10. Changes to These Terms
We may update these Terms from time to time. When we do, we'll update the effective date above and, for material changes, give notice in-app before they take effect. Continued use of the Service after changes take effect means you accept the updated Terms.
11. Governing Law
These Terms are governed by the laws applicable where the operator of Criticscale is established, without regard to conflict-of-law principles. Disputes arising from these Terms will be resolved in the competent courts of that jurisdiction, except where mandatory consumer-protection law gives you a different forum.
